Glow Development – Risk Disclosure, Assumption of Risk, and Liability Waiver

By proceeding to purchase, download, install, or use the Glow Risk/Reward software (the “Software”), you (“User”) acknowledge and agree to the following:

1. Not Investment Advice

   The Software, website content, emails, and any examples are for educational/informational purposes only and do not constitute investment, trading, or financial advice. Glow Development, LLC does not recommend or endorse any trade, strategy, instrument, or broker.

2. Assumption of Risk; Trading Risks

   Futures and other leveraged instruments involve substantial risk and are not suitable for all investors. You may lose more than your initial investment. You are solely responsible for all trade decisions, entry/exit timing, order sizing, and risk management. You understand that order execution may be delayed, rejected, or filled at prices different from expected due to market conditions, slippage, connectivity, platform/broker limitations, or other factors outside Glow Development’s control.

3. Technology and Platform Limitations

   The Software depends on third‑party platforms (e.g., NinjaTrader), data feeds, brokers, internet connectivity, hardware, and operating systems. Glow Development has no control over those services and makes no guarantees about their reliability or performance. The Software may contain bugs or errors and is provided “AS IS,” without warranties of any kind (express or implied), including merchantability or fitness for a particular purpose.

4. User Responsibility and Verification

   You are responsible for understanding the Software features and settings, verifying all orders prior to submission, and monitoring all open positions and orders. You will test in simulation or paper trading before using the Software in live markets.

5. No Liability; Limitation of Damages

   To the maximum extent permitted by law, Glow Development (and its members, officers, employees, contractors, and affiliates) shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or any other damages, including lost profits, trading losses, loss of data, business interruption, or loss arising from the use of or inability to use the Software, site, or related services—even if advised of the possibility of such damages. If liability cannot be fully disclaimed, Glow Development’s total aggregate liability shall not exceed the amount you paid for the Software in the twelve (12) months preceding the event giving rise to the claim.

6. Indemnification

   You agree to indemnify, defend, and hold harmless Glow Development from and against any and all claims, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Software, your trading activities, or your breach of this agreement.

7. Licensing and Access

   Access to the Software may require an active license through a third‑party ecosystem (e.g., NinjaTrader). Glow Development is not responsible for third‑party licensing or access issues.

8. No Guarantees; Past Performance

   No representation is being made that any account will or is likely to achieve profits or losses similar to those shown in examples or simulations. Past performance is not indicative of future results.

9. Entire Agreement; Acceptance

   This agreement constitutes the entire understanding between you and Glow Development with respect to the Software. By selecting “I Agree” and proceeding to checkout, you confirm that you have read, understand, and voluntarily accept this Risk Disclosure, Assumption of Risk, and Liability Waiver.
